One way mental retardation is determined is by IQ, and
if any one's IQ is below 70, he or she is likely to be considered mentally retarded. Mr. Penury has an IQ of 68, so he is
considered mentally retarded and he has committed murder. He killed Patrick Donahue, and there is evidence that he was
involved in two other murders, but the court overturned his conviction. I don't think that was the right thing to do,
and the following reasons explain why I do not agree with the court's decision. First,
even though he is mentally retarded, he knew what he was doing, and he will continue to be a threat to society
if he is not sent to jail, and the Declaration of Independence says everyone is equal, so he should be punished the
same as everyone else. For these reasons, his conviction should not have been overturned.
